Online Policy

Uccello’s Hospitality Group operates restaurants under the names Uccello’s Ristorante and Herb and Fire Pizzeria. When we refer to “Uccello’s” in this privacy policy, we are referring to all restaurants operated directly or indirectly by Uccello’s Hospitality Group, regardless of the restaurant’s name.

Through Uccello’s Hospitality Group’s website, https://www.uccelloshg.com, you can access the websites for Uccello’s Ristorante and Herb and Fire Pizza and our event space, the Atrium: https://www.uccellos.com/, https://www.herbandfirepizzeria.com/ and https://www.theatriumgr.com/, and from there, you can further access websites for our individual restaurants. We collect information from visitors to our websites, including individuals who place online orders, sign up for our loyalty program, apply for jobs at our company or request information about holding an event at one of our locations. This privacy policy (“Policy”) applies to the visitors and users of the websites described above, including our mobile app. The information that we collect through our websites and how it is used is described in this Policy.

Information We Collect

We collect information from you when you provide it to us and/or when you visit, use or navigate any of our websites. Visitors are free to navigate our websites without providing us with any personal information; see Log Files and Cookies That Collect Information Autonomously for information that we collect without your affirmatively providing it to us. If you want to place an order with one of our restaurants (individually or for catering), sign up for our URewards loyalty program, schedule a fundraising event or ask us to co-sponsor an event, communicate with us about employment opportunities, provide us with feedback about your Uccello’s dinging experience, purchase a gift card, or request information about an event generally, we will ask you for some or all of the personal information described below. We may also ask general questions about how you heard about our restaurants or which location(s) you prefer.

You can order takeout or delivery from any of our restaurants through the individual restaurant’s site accessible from the uccellos.com and herbandfirepizzeria.com websites. If you want to place an order online, you will be asked for your name, email address, phone number and credit card information (name, account number, expiration date, zip code and the card’s security code). If you want your order delivered, you will also be asked to provide an address; if you are communicating with us on behalf of a business, we will also ask for the name of the business; and if you are requesting information related to an event, we will ask for details about the event.

Through our websites, you can purchase gift cards for delivery to the recipient via email. In addition to your first and last name and email, we will also ask for your billing address, credit card information as described above, and the first and last name and email of the recipient.

We solicit feedback from our customers on the food and service they have received, and for those who provide it to us, we ask for first and last name, phone, email address, the restaurant location visited and the time and date of the visit, the name of the server, and the check number and for permission to contact you.

Uccello’s URewards loyalty program rewards members with points based on how much they spend when they order from one of our restaurants. URewards members also earn points when they dine in at our restaurants based on information we collect offline The points are redeemable for free or discounted menu items. We also send URewards members a special offer on their birthdays and anniversaries (when they have provided us with those dates), that is redeemable when dining in or ordering takeout or delivery at our restaurants. If you want to join URewards, you will be asked to provide your full name, company name, email address, mailing address, and phone number, and you will be asked to create a password so that you can access your account to track your points. Some of the information we collect is not required to join the URewards program, but if you do not want to provide the required information marked with an asterix (*), you will not be able to participate in the program. At the time you sign up, you will be asked if you want to be added to our mailing list. If you do not uncheck the box that indicates you want to receive emails from us, you will be added to our mailing list. If you do not opt out, you can later change your mind, see Opting Out below.

If you are interested in holding an event at a Uccello’s restaurant, or would like us to consider sponsoring an event you are planning, you can fill out our online contact form and provide us with your full name, phone number, email and company name, and the date, time, size of your event and any other information that you want to make us aware of.

Uccello’s also posts employment opportunities on its websites and individuals interested in working for us can provide the information necessary to apply by clicking the “Careers” link on the websites. The information provided will be used only to evaluate an applicant for employment, to communicate with the applicant concerning potential employment-related matters and, generally, in the course of the process undertaken by Uccello’s to fill the position. We may also retain the information and refer to it when openings similar to the one a job seeker applied for opens up.

We use third party service providers to process online orders, process credit card and other payments, fulfill gift card orders, administer our loyalty program and collect information from people who apply for positions with Uccello’s. The information described above that you provide is stored by our service providers on servers owned or controlled by them and not Uccello’s. Uccello’s accesses and uses the information through its third-party service providers. We do not give our service providers the right to use your information except to provide services to Uccello’s, as described in this Policy. Log Files and Cookies That Collect Information Autonomously

“Cookies” refer to software code that is placed on your phone, computer, or other device in the course of your visiting, using or navigating our websites (and websites generally), and when you upload or download information. We, and/or third parties that provide us with website analytics and other services, use cookies and other technologies to track your use and navigation of our websites and in some cases the particular pages and products or services that you view.

The information collected automatically from your phone, computer or other device may include information about the browser, device and the Internet Service Provider (ISP) you use, the Internet Protocol (IP) addresses involved in your connection to the website, the URL you were at before coming to our website, details about your visit (e.g., what you view, how long you view it or what you click on), your geographic location, and date and time. We and our third-party service providers may access and collect this information when it is available even though you have not affirmatively provided it to us. Information on your geographic location is used to help you locate a Uccello’s restaurant near you.

We and our third-party service providers use this information to administer the websites, to analyze how visitors navigate the websites, to provide users with more relevant content, to improve the usability, functionality and content of our websites, to prevent misuse of our websites, and also to provide technical and customer service and the products and services you order from us. Some of this information is anonymized and is not personally identifiable to you by us. We and our third-party service providers may correlate some information to our users, account holders and/or subscribers and use it in the ways we describe in this Policy.

The information is stored on servers that we or our third-party service providers maintain.

Tracking Options and Do Not Track Disclosures

You can block cookies, including location tracking, by setting Internet browser settings to stop accepting new cookies, to turn off location tracking, to receive notice when a new cookie is received, to disable existing cookies, and to omit images (which will disable pixel tags). More detailed information about cookie management with specific web browsers can be found at the browsers’ respective websites. Blocking or disabling cookies may affect the functionality of our websites. The websites may not respond to Do Not Track requests or headers from some or all browsers.

How We Use The Information We Collect

We use the information that you provide to us and/or our third party service providers (e.g. our payment processor or the service provider that administers our loyalty program) for the purpose for which it was provided to us, including to fulfill orders, respond to requests about events, improve our food and service based on the feedback you provide, and as further described in this Policy.

If we need to contact you about a takeout or delivery order, we may use your email or your phone number to call or text you which may result in additional charges. If you have signed up for URewards, we will use your email address to send you marketing and promotional emails about us that may be of interest to you. We will also send you an offer on your birthday and anniversary, if you have provided us with those dates.

For billing, record keeping, legal, compliance and auditing purposes, and in the course of administering our websites, we may retain and use your information after we have responded to your request, your purchase(s) has been completed and/or you have closed your account or stopped your subscription. We also retain prior delivery information, including phone number, address and items ordered, so that it is available for our reference if you subsequently place orders.

Third Party Access To Your Information

We do not sell your information or provide it to others, except to our related companies (those that are controlled by or affiliated with Uccello’s Hospitality Group) and to third parties who provide services to us as described in this Policy. These include, but are not limited to, the service providers who process our online orders (Toast, EZCater, and MobileBytes), process payments (Heartland Payment Systems), fulfill gift card requests (Gift Rocket) and administer our URewards loyalty program (Paytronix Systems, Inc.). We do not give our third-party service providers the right to use your information except to provide services to Uccello’s. In some cases, your information may be aggregated with other information in a way that does not include any information that would be individually identifiable to you. We and/or the third parties we contract with may use this information to administer the websites, to analyze how visitors navigate the websites, to provide visitors with more relevant content, to improve the usability, functionality and content of our websites, to provide customer service, or to otherwise provide technical or customer support for the websites.

We use third parties to host and administer our websites and in the course of the work they do for us, or to prevent fraud or misuse of our websites, these third parties may access your information.

If a third party were to purchase us or merge any of our companies with theirs, or in the course of negotiating a purchase or merger of some or all of our businesses, we may need to disclose your personal information to the purchaser or prospective purchaser and to transfer your information to the purchaser if such a purchase or merger is concluded. You consent to such disclosure and transfer.

If we are required by law, legal process or in response to requests from law enforcement, or if in our sole determination it is necessary for the protection of our interests or the interests of any of our service providers, we reserve the right to use and disclose your personal information.

Except as described in this Policy, we do not sell or otherwise share your personal information with third parties.

We may include links on our websites to websites that are not affiliated with us, do not provide us with products or services to related to our business, or are not involved in our website administration.

These links are solely for your information, and we have no responsibility for the content or information collection policies of the persons or entities that operate those sites. The privacy policy for a linked site will indicate what information they collect and how they use it.

Opting Out

You can indicate or change your communication preferences in your account settings. You can also “unsubscribe” from our communications by using that feature in communications where it is included. Or you may direct a request to the contact information listed below, see How To Contact Us.

Online Privacy Policy Only

This Policy applies only to our websites and the information collected there. It does not apply to any information collected offline or via channels other than our websites, except as expressly described above.

Consent

By placing an order online, signing up for our loyalty program, applying for employment, inquiring about an event, providing feedback, or otherwise communicating with us, or by visiting our website(s), you agree to our collecting information and using it as we’ve described in this Policy. You can always change your mind and you may have other rights that relate to your information that is in our possession as described in this Policy.

Storing Your Personal Information

We store the information we collect as long as we determine it is reasonably necessary for the purposes described in this Policy, taking into consideration what you have indicated as your preferences related to receiving communications from us. We will not delete any stored information we are legally required to keep for a longer period by applicable U.S. law. When information is aggregated and can no longer be associated with you personally, it may be included in data that we and/or our service providers retain and use indefinitely.

Keeping Your Information Safe

We use one or more third parties to administer and host our websites and the administrator(s) is obligated to use industry standard protocols and software to reduce the risk of loss, unauthorized access, disclosure, or misuse of your Information. However, no data is 100% secure, and we are not able to provide any assurances that the information that we and/or our third-party service providers collect, and store will be secure or that it will not be subject to loss, unauthorized access, use or disclosure.

Use by Children

Our websites are intended for a general audience, consistent with our customers who purchase food and beverages at our restaurants and who are U.S. residents. Children under 13 are not eligible to sign up for URewards and we do not intend to collect information from anyone under the age of 13. If you are the parent or guardian of a child under the age of 13 and believe we may have collected information about your child, please contact us at the email or mailing address below. In such a case, you may review and request deletion of your child’s information as well as prohibit any use of that data.

Updates and Revisions to this Policy

We may change or update this Policy from time to time. We encourage you to check for updates.

California law gives California residents the right to request certain information relating to what we have collected (and are storing) from or about them.
